Saleswhale Privacy Policy

1. Introduction and Scope

Saleswhale, Inc. (“Saleswhale,” “we,” “us,” “our”) takes the protection of personal data very seriously. The following practices govern how we collect, use, share, and protect the information you provide to us through your use of our websites (each a “Site”) and other information we might collect about you and the choices you have regarding our collection and use of your information. This Privacy Notice (the “Notice”) also addresses Personal Data we may receive in our hosted artificial intelligence-based sales assistant software application (the “Service”). In this Notice, “Personal Data” means information that may be used to identify you personally, such as your name, street address, email, or telephone number, and any other information that relates to you.

In addition, our customers use our hosted technology platform to store and process Personal Data of their own leads, prospects, customers, and former customers, at their own discretion. In this circumstance, we act only as a storage and service provider, without any interest in or knowledge about what is being stored. In general, we only access such Personal Data at our customer’s request in connection with customer support or account administration matters—all as is reasonably necessary in order to provide the services that our customer has directed us to provide, or as may be required by law.

2. What Information does Saleswhale Collect?

A. Use of Our Sites

The types of Personal Data we might collect about you when you use our Sites could include the following:

  • Identifiers: Information that identifies you directly or could be used to identify you.
    • Examples: Full name, email address, social media account information, phone number, job title and description, company name, customer account information, IP address, and other data that identifies or could identify your online activity.
  • Commercial Information: Information related to purchases that you or your company might make in connection with our Services.
    • Examples: Purchase history, products considered.
  • Online Activity: Limited information about your use of the internet collected via web analytics.
    • Examples: Browsing and/or search history regarding sites visited before or after visiting our Sites, the type of operating system used to connect to our Sites, interactions with our services or our advertisements, browser type, internet service provider, the date and time of your visit, the amount of time you spend on each page, information about the links you click, and pages you view on the Sites, and your preferences when you use the Sites.
  • Geo-IP Information: Information about where your computer or device is approximately located (at the city or state level) when you use the Sites.
  • Inferences: Information we can determine or estimate about you based on information we collect about you.

B. Submitted to Our Service

The types of Personal Data we might collect about you when submitted by our customers in their use of the Service could include the following:

  • Identifiers: Information that identifies you directly or could be used to identify you.
    • Examples: Full name, email address, social media account information, phone number, job title and description, company name, customer account information, IP address, and other data that identifies or could identify your online activity.
  • Professional or Employment-Related Information: Information about you that is connected to the work that you do.
    • Examples: Business communications.
  • Geo-IP Information: Information about where your computer or device is approximately located (at the city or state level).
  • Inferences: Information we can determine or estimate about you based on the information we collect about you.

3. How We Receive Personal Data

  • Depending on your relationship with Saleswhale, we may collect Personal Data from you in different ways. Some of the ways that Saleswhale may collect Personal Data include:When you give us Personal Data directly, including through contact forms on our Sites, surveys, registering for or participating in events, or by emailing or calling us to request products, services, or information. This Personal Data would include the specific identifiers that you provide directly to us.
  • When you post user-generated content on our Sites, we will collect information you provide in such submissions, including identifiers you submit. User-generated content you submit to any public areas of the Sites is considered “public,” and will not be subject to the privacy protections in this Notice.
  • When we collect information about your online activity automatically through our Sites through web analysis, such as your internet protocol (IP) address, cookie identifiers, and other identifiers that are automatically assigned to your computer or devices when you access the internet.
  • When our subscriber customers (“Subscribers”) use our artificial intelligence model for sales assistant software application. When acting as a service provider/processor for our Subscribers who use our Services, we may receive your Personal Data from those Subscribers. This could include your identifiers, business communications, and geo-IP location—all governed by Subscriber’s privacy policies (collectively, “Subscriber Provided Information”).
  • From third-party providers who gather such data from a variety of publicly available sources (“Publicly Identifiable Information”). Such information could include identifiers, such as company name, name and title of the company’s officers, and certain company employees, business phone numbers, fax numbers, email addresses, social media data, and similar information. We may combine this information with information collected as described above.

Except as may be applicable for our employees or job applicants, we do not knowingly collect sensitive Personal Data (such as medical or health conditions, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership or information specifying the sex life of an individual.)

4. How We Use Personal Data

We process Personal Data for a variety of purposes, but only for the reasons for which we collected it. As applicable, we only process Personal Data when we have a legal basis to do so, as explained in this Notice.

We use the Personal Information we collect for the following business purposes.

  • To Provide Products, Services, or Information Requested: Saleswhale may use your Personal Data to fulfill requests for products, services, or information, including information about potential or future services, including to:
    • Manage your information and accounts;
    • Respond to your inquiries;
    • Provide access to certain features of the Sites;
    • Allow you to register for events.
  • Administrative Purposes: Saleswhale may use your Personal Data for its administrative purposes, including to:
    • Measure interest in Saleswhale’s services;
    • Ensure internal quality control;
    • Communicate with you about your accounts and activities involving us and our services, including changes to our Sites or services;
    • Verify your identity or account, as necessary;
    • Process payment for products or services purchased;
    • Process applications and transactions;
    • Comply with regulatory requirements;
    • Prevent potentially prohibited or illegal activities;
    • Enforce our Terms of Use at https://saleswhale.com/
  • Research and Development: We may perform survey research (online and offline). Sometimes we may ask third parties to conduct this research for us. You do not have to participate in these surveys. We will use the information we collect for research and reporting purposes to help us improve our Sites and services. Similarly, if you post any user-generated content to the Sites, Saleswhale, and our customers, may use this information to improve our products or overall customer experience.

We use the Personal Data we collect for the following commercial purposes:

  • Marketing Saleswhale Products and Services: Individuals who provide us with Personal Data, or whose Personal Data we obtain from third parties (other than Subscriber-Provided Information), may receive periodic emails, newsletters, mailings, or phone calls from us with information about us or our business partners’ products and services or upcoming special offers/events we believe may be of interest and as permitted by applicable law. If you prefer that we not use your Personal Data for these purposes you may opt-out as described in Section 8 of this Notice. We may display personal testimonials and other endorsements on our Sites. With your consent, we may post your testimonial along with your name.
  • Subscriber-Provided Information: Saleswhale may use Subscriber-Provided Information to process data for our Subscribers which typically involves our AI sales assistant automatically responding to inquiries made by our Subscribers’ sales leads. We may use Publicly Identifiable Information to provide business-to-business contacts and enriched data to our customers and for such business purposes as permitted under our agreements.
  • De-Identified and Aggregated Information: Saleswhale may use Personal Data and other information you provide to us or that we collect about you to create de-identified and aggregated information that does not directly identify you. We use this information for a variety of functions, including learning more about our current services, and developing new services. De-identified or aggregated information is not Personal Data. We may share this information within Saleswhale and with third parties in a de-identified or aggregated form that is designed to prevent anyone from identifying you.
  • Other Uses: We may use Personal Data for other purposes for which we have a legitimate interest, such as direct marketing, individual or market research, anti-fraud protection, or any other purpose disclosed to you at the time you provide Personal Data or with your consent.
  • New Uses of Personal Information: Before we use Personal Data for any new purpose not originally disclosed to you, we will endeavor to provide information regarding the new purpose through updates to this Notice or other means to give you the opportunity to opt out. Where we are legally required to get your consent before processing Personal Data, we will comply with that requirement.
  • Combining Personal Information: As described in Section 3 above, we may purchase information from third parties to combine with Personal Data we have already collected from you. We purchase this information for our internal marketing purposes, and also to provide to our customers as part of our services.

Data Retention

We retain the Personal Data we process on behalf of our Subscribers for as long as needed to provide the Services to our Subscribers or as necessary to fulfill the purpose(s) for which it was collected. We will retain and use this Personal Data as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

5. How We Share Personal Data

We may share your information as described in this Notice or with your permission.

A. Sharing Personal Data with Third Parties

  • Service Providers. We share Personal Data with our service providers, who process Personal Data on behalf of Saleswhale, and who agree to use the Personal Data only to perform the Services for us or as required by law. Our service providers may be located within or outside of the United States; however, we will require that those third parties maintain at least substantially the same level of confidentiality that we maintain for such Personal Data. Saleswhale remains liable for the protection of your Personal Data that we transfer to our service providers, except to the extent that we are not responsible for the event giving rise to any unauthorized or improper processing. Our service providers include businesses that provide:
    • internet hosting and infrastructure services;
    • office management services;
    • cloud storage services; and
    • customer service software.
  • Business Partners. Saleswhale may share Personal Data with our business partners and affiliates to fulfill our contractual commitments, or to provide you with a product or service that you have requested. We also share this information for marketing or sales purposes including in connection with conferences or events where (if applicable) you have consented to sharing. Saleswhale may also provide Personal Data to business partners we work with to jointly offer products or services, or whose products or services we believe may be of interest to you.
  • Subscribers. We may share Publicly Identifiable Information we collect and process for our Subscribers with our Subscribers. Our Subscribers’ privacy policies discuss how they will use this information.
  • Affiliates. We may share Personal Data with our affiliated companies.
  • Interest-Based Advertising and Third-Party Marketing. We may allow third-party advertising partners to set tracking tools on our Sites to collect information regarding your online activity. For more information about this, see Section [X] below. We may also use this and other Personal Data (such as demographic information) with third-party advertising partners. These advertising partners may use this information (and similar information collected from other websites) to provide you with more relevant advertisements when you visit non-Saleswhale-related websites within their networks. This practice is commonly referred to as “interest-based advertising” or “online behavioral advertising.” If you prefer that we do not share your Personal Data with third-party advertising partners, you may opt out as described in Section [X] of this Notice.

B. Other Sharing of Personal Data

We may also share Personal Data:

  • to the extent required by law or if we have a good-faith belief that such disclosure is necessary in order to comply with official investigations or legal proceedings initiated by governmental and/or law enforcement officials, or private parties, including but not limited to: in response to subpoenas, search warrants, or court orders, provided that in such instances we may not be able to ensure that such recipients of your Personal Data will maintain the privacy or security of your Personal Data;
  • if necessary to enforce Saleswhale policies or contracts or other commitments;
  • when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation or prosecution;
  • if we, in good faith, believe that disclosure is otherwise necessary or advisable; or
  • if we sell or transfer all or a portion of our company’s business interests, assets, or both, or in connection with a corporate merger, consolidation, restructuring, or other company change.

6. Cookies, Pixel Tags/Web Beacons, and Analytics Information

We, as well as third parties that provide content, advertising, or other functionality on our Sites may use cookies, pixel tags, local storage, and other technologies (“Technologies”) to automatically collect information. These Technologies are essentially small data files placed on your computer, and other devices, that allow us to record information whenever you visit or interact with our Sites, services, applications, messaging, and tools, and to recognize you across devices.

A. Cookies

A “cookie” is a small file stored on your device that contains information about your device. We may use cookies to provide Service functionality, authentication (session management), usage analytics (web analytics), and generally improve our websites and Services.

If you would prefer not to accept cookies, you can change the setup of your browser to reject all or some cookies. Note, if you reject certain cookies, you may not be able to use all of our Services’ features. For more information, please visit https://www.aboutcookies.org/.

B. Analytics and Internet-Based Advertisers

We may also use Google Analytics and other vendors to collect information regarding visitor behavior and visitor demographics on some of our services and to remarket to audiences visiting the Sites and to develop Site content.

  • For more information about Google Analytics, please visit http://www.google.com/policies/privacy/partners. You can opt out of Google’s collection and processing of the data that is generated by your use of the services by going to http://tools.google.com/dlpage/gaoptout. We may have similar arrangements with internet-based advertisers that might display ads when you visit our Sites. These companies may collect personal and other information about your visits to this and other sites to provide ads about products and services that might be of interest to you. The privacy policies and practices of these third-party providers will govern their use and collection of this information.

C. Use of Technologies

We use the Technologies as follows:

  • Strictly Necessary. We use Technologies that are necessary to operate our Sites, services, applications, and tools. This includes Technologies that allow you to access our Sites, services, applications, and tools that are required to identify irregular Site behavior, prevent fraudulent activity and improve security; or that allow you to use shopping carts, saved search, or similar functions. The Sites usually only set these cookies when you make a specific action, like setting privacy preferences, or logging into the Sites. You can set your browser to block or alert you about these cookies, but some parts of the Site may then not work.
  • Performance. We may use Technologies to assess and improve the performance of our Sites, applications, services, and tools, including to help us understand how our visitors use our Sites, determine if you have interacted with our messaging, or determine whether you have viewed an item or link. All information these Technologies collect is aggregated and de-identified.
  • Functional. We may use Technologies to offer you enhanced functionality when accessing or using our Sites, services, applications, or tools. This may include identifying you when you sign into our Sites or keeping track of your specified preferences, interests, or past items viewed so that we may enhance the presentation of content on our Sites. If you do not allow these Technologies, then some or all of these services may not function properly.
  • Targeting. We may use Technologies to deliver content, including ads relevant to your interests, on our Sites or on third-party sites. This includes using Technologies to understand whether the advertising you see is useful, such as whether you have clicked on an advertisement. Saleswhale and our advertising partners may set these Technologies. Our advertising partners may use these Technologies to build a profile of your interests and show you relevant advertisements on other Sites.
  • Social Media. Social media services set these Technologies to enable you to share our content with your friends and networks. They are capable of tracking your browser across other sites and building up a profile of your interests. This may impact the content and messages you see on other websites you visit.
    Opting Out of Technologies. If you would like to opt-out of the Technologies we employ on our Sites, services, applications, or tools, you may block, delete, or disable them through your browser, as applicable. The online advertising industry also provides websites you can use to opt out of receiving targeted ads from advertising partners that participate in self-regulatory programs. You can access these and learn more about targeted advertising and consumer choice and privacy at http://www.aboutads.info/choices/, http://www.youronlinechoices.eu/, https://youradchoices.ca/choices and http://www.networkadvertising.org/managing/opt_out.asp. Alternatively, for some devices you may use your device’s platform controls to make choices about these Technologies. Please note that you must separately opt out in each browser and on each device and that cookie-based opt-outs are not effective on mobile applications.

D. Do Not Track Signal

You may also set your browser to send a Do Not Track (“DNT”) signal. For more information, please visit https://allaboutdnt.com/. Please note that our Sites do not have the capability to respond to “DNT” signals received from web browsers.

7. Data Integrity & Security

Saleswhale has implemented and will maintain technical, administrative, and physical measures that are reasonably designed to help protect Personal Data from unauthorized processing such as unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the internet, or method of electronic storage, is 100% secure. We do not accept liability for unintentional disclosure, and you acknowledge that we are not responsible for any intercepted information sent via the internet. By using our Sites or communicating Personal Data to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of our Sites. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on the Site or sending an email to you. You may have a legal right to receive this notice in writing.

8. Access, Review & Deletion

If we store Personal Data about you, you may have a right to request access to, and the opportunity to update, correct, or delete, such Personal Data. You may also have the right to opt out of having your Personal Data shared with third parties and to revoke your consent that you have previously provided for your Personal Data to be shared with third parties, except as required by law.

You also have the right to opt out if your Personal Data is used for any purpose that is materially different from, but nevertheless compatible with the purpose(s) for which it was originally collected or subsequently authorized by you. Requests should be sent to the Saleswhale Subscriber who provided your Personal Data to Saleswhale, or to Saleswhale directly at [email protected].

Saleswhale has limited access to Personal Data our Subscribers submit to our Service. Therefore, if you contact us with such a request, please provide the name of the Saleswhale Subscriber who submitted your Personal Data to our Service. We will forward your request to that Subscriber and provide assistance to our Subscribers, as needed, as they respond to your request.

9. EU Citizen Privacy Rights

For residents of the European Economic Area, Saleswhale is the data controller responsible for the personal information collected on the Sites. If you are a citizen of a country in the European Economic Area, you have the right to:

  • Access or port Personal Data about you consistent with legal requirements. You also have the right to receive or have your electronic Personal Information transferred to another party.
  • Request correction of your Personal Data where it is inaccurate or incomplete. We may provide tools you can use yourself to update your Personal Data or we may refer you to our Subscriber or other controller of your Personal Data who is able to make the correction.
  • Request deletion of your Personal Data, subject to certain exceptions prescribed by law.
  • Request restriction of or object to processing of your Personal Data, if applicable, where such requests are permitted by law.

Saleswhale commits to resolve complaints about your privacy and our collection or use of your personal information. 10. California Privacy Rights

The California Consumer Privacy Act (“CCPA”) provides certain legal rights for California residents. This section generally describes those rights and how you may exercise them in connection with our practices described in this policy.

Saleswhale has disclosed Personal Data in the categories identified in Section 2 to its vendors and service providers in the last 12 months for the purposes described in Section 4, including to provide services to our Subscribers or for operational and other purposes as permitted in our agreements with Subscribers and as provided in this Notice.

A. No Sale.

Saleswhale does not sell Personal Information as sell and personal information are defined in the CCPA. With respect to Subscribers, Saleswhale acts solely as a service provider (as defined in the CCPA). We do not and will not knowingly sell Personal Information of minors who are younger than 16.

B. Your Rights.

If you are a California resident, you have the right to:

  • Access. You can request that we disclose certain information to you about our collection and use of your Personal Data in the past 12 months with respect to our role as a “business” under the CCPA. Once we receive and verify your request, we will give you the following information:
    • The categories of Personal Data we collected about you.
    • The categories of sources of Personal Data we collected about you.
    • Our business or commercial purpose for collecting or selling that Personal Data.
    • The categories of third parties with whom we share that Personal Data.
    • The specific pieces of Personal Data we collected about you.
  • You can request that we delete the Personal Information that we collected from you. Once we receive and verify your request, we will delete your Personal Data from our records. We are not required to delete information if we need to use it for the following:
    • Completing a transaction or contract with you.
    • Detecting security interests, protecting against malicious, deceptive, fraudulent, or illegal activity, or prosecuting people responsible for that activity.
    • Debugging our products to identify and repair errors to our Services.
    • Exercising, and allowing others to exercise, free speech, or other legal rights.
    • Internal uses that align with your expectations.
    • Complying with a legal requirement.
    • Other internal and lawful uses consistent with the reasons you provided the information.
  • Non-Discrimination. We will not discriminate against you for exercising any of your CCPA rights

In order to protect your privacy, we will ask you to verify your identity before we can act on your access or deletion request. This process may require you to provide additional information, which we will only use for verification purposes.

11. Other Rights and Important Information

A. Data Transfers

All Personal Information we collect may be stored anywhere in the world, including but not limited to, Singapore and the United States, in the cloud, on our servers, or on affiliate or third-party service provider servers. Law enforcement or other authorities may access your Personal Data pursuant to a lawful request. By providing information to Saleswhale, you consent to the storage of your Personal Data in these locations.

B. Human Resources Data

With regard to Personal Data that we receive in connection with the employment relationship, we will use such Personal Data only for employment-related purposes. If Saleswhale intends to use this Personal Data for any other purpose, we will notify the individual and provide an opportunity to opt out of such uses. Saleswhale’s use of Personal Data received in connection with employment-related purposes is governed by Saleswhale’s internal policies

C. Children’s Privacy

We do not knowingly collect, maintain, or use Personal Data from children (individuals under 13 and, in certain jurisdictions, under the age of 16) and no part of the Sites are directed to children. If you learn that your child has provided us with Personal Data without your consent, you may alert us at [email protected]. If we learn that we have collected any Personal Data from children, we will promptly take steps to delete such information and terminate the child’s account

D. International Users

By using the Sites, Saleswhale will transfer data to Singapore and to the United States. By choosing to visit the Sites or otherwise providing information to us, you agree that any dispute over privacy or the terms contained in this Notice will be governed by the laws of the State of California and the adjudication of any disputes arising in connection with 6sense or the Sites will be in accordance with the Terms. If you are visiting from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your information to Singapore and to the United States and processing globally. By providing your Personal Data, you consent to any transfer and processing in accordance with this Notice.

12. Changes to this Notice

Saleswhale may change this Notice by posting an updated or revised Notice on our Sites. Please check this Notice periodically so that you will remain up-to-date. If you continue to visit the Sites and use the services made available to you after such changes have been made, you hereby provide your consent to the changes.
