California Recruitment Privacy Notice and Policy

1. Introduction

6Sense Insights, Inc. (“6sense,” “we,” “our” or “us”) is committed to protecting the privacy and security of your personal information. As used herein, “You,” or “Your” means an applicant that has identified themselves as a resident of California. This California Recruitment Privacy Notice and Policy (“Recruitment Notice”) does not apply to any applicants who are not residents of California.

You have been provided with a copy of this Recruitment Notice because you are applying to work with us (whether as an employee, worker or contractor). It provides you with certain information that must be provided under the California Consumer Privacy Act (“CCPA”). As used in this Notice, “personal information” is information that identifies or is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household. This Notice makes you aware of how and why your personal information will be used, and how long it will be stored.

If you are successful in your application, you will be provided with a separate privacy notice relating to your employment with us. This Recruitment Notice does not form part of any contract or guarantee of employment or other contract to provide services.

We collect the information identified in this Recruitment Notice under “Collection and Use of Your Personal Information” for business purposes identified under “How We Use Your Personal Information.” To learn more about your privacy rights, please see “Your California Privacy Rights.” For more information about the use of your personal information outside of your application to work with us, please see our Privacy Policy on our website.

It is important that you read this Recruitment Notice, together with any other notice we may provide on specific occasions when we are collecting or processing your personal information, so you are aware of how and why we are using such information.

2. Collection of Your Personal Information

In most instances we collect personal information directly from you. In other instances, we may collect personal information from:

  • Recruitment agencies.
  • Your named references.
  • Publicly available sources (such as LinkedIn).

This personal information we collect may include, but is not limited to:

  • Identifiers / Contact Information, such as your name, address, phone and fax number, email
    address and location.
  • Professional or Employment-Related Information, which could include, for example:
    • Employment data and history (such as job title, work location, division, department, position
      level, and references);
    • Any information you provide to us during an interview; and
    • The results of any tests or assessments as part of our interview process.
  • Internet or other Electronic Network Activity Information, such as cookies and IP addresses, if you have applied via our website. For more information about the use of your personal information outside of your application to work with us, please see our Privacy Policy on our website.
  • Audio, Electronic, or Visual Information, such as your photograph.
  • Education Information, such as education history.
  • Inferences drawn from the above categories of personal information.
  • Sensitive Personal Information, such as your racial or ethnic origin, or your disability status. The collection and processing of your Sensitive Personal Information is not for the purpose of inferring characteristics about you. Any Sensitive Personal Information is collected via a voluntary self-identification form, and used or disclosed for a CCPA-permitted business purpose.

We take steps to protect the confidentiality of personal information and information from disclosure to third 3 parties, except on a need-to-know basis, and consistent with the terms of this Recruitment Notice.

3. How We Use Your Personal Information

We may use the personal information described in Section 2 (“Collection of Personal Information”) for the business purpose of collecting employment-related information, including but not limited to:

  • Assess your skills, qualifications, and suitability for the role.
  • Carry out reference checks, where applicable.
  • Communicate with you about the recruitment process.
  • Keep records related to our hiring processes.
  • Comply with legal or regulatory requirements.

We are guided by the principle that you should not be surprised by any use we make of your personal information. As defined in the CCPA, we do not “sell” or “share” your information collected pursuant to your application to work with us, including your personal information or sensitive personal information.

4. Recipients and Disclosure of Your Personal Information

We may disclose your information as described in this Recruitment Notice or with your permission. In the past 12 months, we have disclosed personal information described in Section 2 (“Collection of Personal Information”) for the purposes described in Section 3 (“How We Use Your Personal Information”) with the following categories of recipients:

  • Service Providers. We may share your personal information with third-party contractors, partners, vendors, and providers we use to perform functions on our behalf, such as recruitment agencies, our candidate/employee management and recruiting systems, and parties involved with pre-employment checks, like a check of your provided references.
  • Affiliates. We may share your personal information with our affiliated companies.
  • Legally Required Disclosures. We may disclose your personal information if necessary to: (i) comply with legal requirements, such as a court order or subpoena; (ii) protect your, our, or others’ rights, property, or safety; (iii) to enforce our policies or contracts or other commitments; (iv) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation or prosecution; or (v) if we, in good faith, believe that disclosure is otherwise necessary or advisable.
  • Merger, Sale, or Other Asset Transfers. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, we may transfer your personal information in connection with this transaction. Should such an event occur, we will make efforts to ensure that the recipients use your personal information consistent with this Notice.

Our third-party service providers and other entities in the group are required to take appropriate security measures to protect your personal information in line with our policies, as applicable. We only permit our third-party service providers to process your personal information for specified purposes and in accordance with our instructions.

5. Length of Storage of Your Personal Information

We will retain your personal information for no longer than 12 months after we have communicated to you our decision about whether to offer you employment with us. We retain your personal information for that period so that we can show, in the event of a legal claim, that we have not discriminated against candidates on prohibited grounds and that we have conducted the recruitment exercise in a fair and transparent way. After this period, we will securely destroy your personal information in accordance with our data retention policy.

If we wish to retain your personal information on file, on the basis that a further opportunity may arise in future and we may wish to consider you for such opportunity, we will write to you separately, seeking your explicit consent to retain your personal information for a longer period. If we do not contact you in 24 months, we will delete the data. You have the right to request deletion of your personal information at any time. To request deletion of your personal information, please contact us as set out below.

6. Your California Privacy Rights

If you are a California resident, you may take advantage of the following privacy rights:

  • Right to Know: You have the right to know what personal information we have collected about you, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom we disclose personal information, and the specific pieces of personal information we have collected about you.
  • Right to Delete: You may request that we delete the personal information that we have collected from or about you. Note that there are some reasons when we will not be able to fully address your request, such as if we need to complete a transaction for you, to fulfill a contractual obligation, to detect and protect against fraudulent and illegal activity, to maintain for internal purposes, to comply with a legal obligation or to preserve or exercise our rights.
  • Right to Correct: You have the right to correct inaccurate personal information that we may maintain about you, subject to appropriate verification.

Right to Non-Discrimination. You have a right not to receive discriminatory treatment from 6sense for exercising your privacy rights conferred by law.

No Share/Sale of Personal Information Collected Pursuant to Your Employment Application. We do not “sell” or “share” information collected pursuant to your application to work with us, including your personal information or sensitive personal information. Accordingly, we do not have actual knowledge of the sale or share of personal information for consumers under the age of 16.

Exercising Your Rights. To exercise your right to know, delete, or correct under California law, please submit a request in the 6sense Privacy Center located at www.6sense.com/privacy-center. Please be sure to select “Current or Former 6sense Applicant” where appropriate. Alternatively, you may send an email to
[email protected]. We may request certain information to verify your identity before we can respond to your privacy rights request.

Authorized Agent Requests. You may authorize someone to make a privacy rights request on your behalf (an “Authorized Agent”). An Authorized Agent will need to demonstrate that you’ve authorized them to act on your behalf. 6sense retains the right to request confirmation directly from you confirming that the Authorized Agent is authorized to make such a request, or to request additional information to confirm the
Authorized Agent’s identity. An Authorized Agent may make a request on your behalf by sending an email to [email protected].
